Terms & Conditions

These Terms & Conditions regulate the use of crednovarytqx.com and the contractual relationship between Crednovarytqx SpA and the users who participate in real estate crowdlending operations. By using the platform you accept these conditions in full. If you do not agree with any clause, please refrain from using the service.

1. Object

Crednovarytqx provides a technological platform that allows registered users to participate, as lenders, in financing operations linked to residential real estate projects located in Chile. The platform does not act as a bank, nor as an investment fund manager, nor as a real estate broker.

2. Registration and accreditation

To participate you must be of legal age, have full legal capacity and complete the identification and accreditation processes required by Chilean regulation, including AML/CFT controls.

3. Investment risks

All operations carry risks, including delays in execution, lower-than-expected returns or partial or total loss of the contributed capital. Crednovarytqx does not guarantee any specific return; figures published are estimates based on the developer's models.

4. Costs and commissions

Crednovarytqx charges a structuring and administration commission, which is communicated transparently for each project before confirming any contribution.

5. Withdrawal and liquidity

Participations are not freely transferable until the project ends or the secondary mechanism made available by Crednovarytqx is activated. Users acknowledge the illiquid nature of these operations.

6. Tax obligations

Returns are subject to the Chilean tax framework. Each user is responsible for complying with their tax obligations and for declaring any income obtained through the platform.

7. Use of the site

It is forbidden to use the platform to carry out illicit activities, to disrupt its operation, to access unauthorised areas or to use automated tools for massive data extraction without express authorisation.

8. Intellectual property

All content, source code, trademarks, logos and graphic resources of crednovarytqx.com are the property of Crednovarytqx SpA or its licensors. They may not be reproduced without prior written authorisation.

9. Liability

To the extent permitted by Chilean law, Crednovarytqx will not be liable for indirect damages, loss of profit or business opportunities arising from the use of the platform or from market developments.

10. Applicable law and jurisdiction

These Terms & Conditions are governed by the laws of the Republic of Chile. Any dispute will be submitted to the ordinary courts with jurisdiction over the city of Santiago de Chile, without prejudice to the rights that consumer protection legislation may grant to natural persons.
